This document sets out the official Terms & Conditions for using the Takka Store platform and clarifies the legal relationship between the platform and the merchants using its services. Please read it carefully before you start building your online store.

Acceptance and agreement

• Your use of the platform means your explicit and full agreement to all the terms and conditions stated on this page.
• If you do not agree to any of these terms, you must immediately stop using our services.
• Electronic acceptance at sign-up is legally binding and carries the force of formal paper contracts.

Key definitions

• Takka Store / the platform / we: refers to the owning company and its applications, technologies and services.
• User / merchant / you: the natural or legal person who registers to build an online store.
• End customer: the buyer who browses or purchases products through your online store.
• Service: all the technical solutions, e-commerce tools and hosting we provide.
• Content: all the text, images, data and products you upload inside your store dashboard.

Legal eligibility to use

• You must be at least the legal age to conduct business in your country of residence, with a minimum of 18 years.
• You must have full legal capacity to enter contracts and establish commercial businesses.
• You must provide correct, accurate information about your identity and activity and update it as soon as any changes occur.
• You must not have previously been banned or had your account closed with us due to any legal violations.

Account management and registration

• You are primarily responsible for protecting your login credentials and not sharing them with unauthorized parties.
• You bear full legal responsibility for all activities and transactions carried out through your account.
• You must notify us immediately if your account is compromised or accessed without authorization.
• We reserve the right to suspend or delete any account based on fake data or engaged in suspicious activity.

Subscriptions, payment and billing

• We offer a range of subscription plans billed periodically according to the package you choose. See pricing.
• The subscription renews automatically on its due date unless you cancel it manually.
• You are responsible for collecting local taxes on your sales and remitting them to the relevant authorities in your country.
• You may upgrade or downgrade your plan at any time, and refunds are subject to the applicable refund policy.

Permitted use of the platform

• The platform may be used for lawful commercial purposes only, in compliance with local and international laws.
• Selling any prohibited products or publishing content that violates the rights or privacy of others is forbidden.
• Using your store for fraud or sending spam without explicit consent is not allowed.
• We block any hacking attempts or use of automated software without prior written permission. Acceptable Use Policy.

Ownership of your content

• You are the original owner of all content, data and products you add to your online store.
• You grant us an operational license to host and display your content to ensure the service is delivered to your customers.
• You bear the legal responsibility for the displayed content and for it not infringing any party's rights.
• We have the right to remove any content that violates the law or breaches the terms of this agreement.

Intellectual property protection

• The platform in its entirety — logos, software and designs — belongs exclusively to Takka Store.
• Under your subscription you receive a limited license; you may not replicate the tools or reverse-engineer its code.
• We respect third-party rights and take copyright-infringement notices seriously.

Third-party integrations

• You may use integrations with payment gateways, shipping carriers and digital-marketing tools.
• We are not responsible for the quality or continuity of services provided by these parties outside our platform.
• Those companies' terms apply when you use their services, and you agree to share the data necessary to operate them.

Suspension and termination of service

• You have the right to terminate your account and cancel your subscription at any time via the dashboard settings.
• We have the right to suspend or close your account immediately upon proven serious violations of the terms.
• Upon termination your store will be shut down; we therefore advise you to save your data before closure.
• Some clauses remain in force after cancellation, such as disclaimer of liability, indemnity and intellectual-property rights.

Disclaimer and limitation of liability

• The service is provided "as is" without absolute guarantees of being free from downtime or software errors.
• You are legally responsible for managing your store, dealing with customers, and the quality of the products you offer.
• We bear no responsibility for lost profits or any indirect damages resulting from your use of the platform.

Indemnity and protecting the platform

• You agree to indemnify us against any claims or lawsuits brought by external parties due to your non-compliant use.
• You bear the cost of damages resulting from publishing non-compliant content or selling products that infringe others' rights.

Governing law

• This agreement is governed by and interpreted in accordance with the laws in force in the country of Takka Store's headquarters.
• Exclusive jurisdiction lies with the courts of the company's headquarters to hear any dispute not resolved amicably.
• We encourage resolving disputes through mediation or amicable arbitration before resorting to formal litigation.

Changes to the terms

• We reserve the right to amend these terms at any time to serve business interests and legal compliance.
• We will notify you of any material changes via email or a notice in the dashboard.
• Your continued use of the platform after updates constitutes acceptance of the amended terms.
• If you reject the amendments, you have the right to stop the service and close your account immediately.

General legal provisions

• Severability: if any clause is deemed invalid, the remaining clauses stay valid and enforceable.
• Entire agreement: this document represents the final agreement, superseding any prior understandings.
• No waiver: our not enforcing any right is not considered a waiver of exercising it in the future.
• Force majeure: we are not responsible for any failure or delay caused by circumstances beyond our control.
